AMICUS guidance on submitting an appeal against rejection of a voluntary redundancy application

AMICUS will not be providing assistance on challenging selection for Compulsory Redundancy to non-members. Though the MAN05 reps have a policy that they are unlikely to provide individual advice and representation over the redundancy exercise to those who were not members by 31 January, those who join now will still have access to information and general advice.

However, since the acceptance of any volunteers helps prevent Compulsory Redundancy of members, we are making available to all staff this guidance on appealing against rejection of application for Voluntary Redundancy.

This guidance has been compiled by the MAN05 AMICUS reps, in consultation with our Regional Officer, Glyn Thomas. It only covers the submission of your letter of appeal - we will be providing further guidance on the rest of the appeal process in due course.

Guidance

  1. ICL are requiring rejected employees to lodge their appeal in writing within 5 working days of notification that their application for VR has been unsuccessful. While we are trying to get this deadline extended, we advise members to ensure that their appeal is lodged within this deadline. Within that deadline, take your time, and make sure you are happy with your appeal letter.
  2. ICL are requiring the appeal to be lodged using this form. Since the form provides little space for comments, you may wish to write in the space provided "please see attached sheet", and put your appeal details in a separate document.
  3. This guidance can only be generic. Members should discuss their appeal with a union rep as early as possible.
  4. Find out as soon as possible which rep would be representing you at any appeal meeting, and make any necessary arrangements as early as you can.
  5. Familiarise yourself with the proposed appeal process, which is part of the "selection criteria" document. AMICUS is still seeking changes to the process, but we can only work with the documents as they stand for now. Check the relevant CafeVIK communities and the MAN05 AMICUS email newsletters for any updates.
  6. Look at the definition of the selection pool you are in, and the selection "profile" for your pool. Work out if there are any issues with either of these.
  7. Ensure you add any points relating to your own personal situation to the model appeal letter below.
  8. Don't make your letter exhaustive - make it clear that it is only a summary of the main points.
  9. Whether you send in your appeal by post or email, keep a copy for yourself.
  10. If you send your appeal in by email, remember to select the options to ask for delivery and read receipts, so you can prove you sent it.
  11. If you post your appeal letter, make a note of when and where you posted it.
